The Lokpal Bill joint drafting committee has moved towards formulation of a draft with civil society members and government representatives agreeing to set up an independent and autonomous authority that will be endowed with financial and administrative autonomy.
Mean while the sticky issue of inclusion of the Prime Minister and the higher judiciary under the Bill was set aside for “further discussion''. The panel agreed to do away with hitherto provisions under the law for sanction of higher authority to investigate and prosecute politicians and senior bureaucrats on corruption charges.
According to the Lokpal bill, the Lokpal can have the power to investigate and prosecute a Chief Minister without any sanction from any authority. Were at present, to investigate and prosecute a chief minister, the Governor's sanction is required.
Another point that emerged was whether or not the appointment of Lokayuktas be constitutionally provided for in the proposed Bill to maintain uniformity in the anti-corruption law. For this decision to be taken the panel need to have consultations with the state governments.
It was agreed that the process of selecting the Lokpal would be “broad-based, transparent and participatory.'' For this a search committee would be put in place.
